General Information and Booking Conditions

HOUSE INFORMATION

House standards

All our properties are individually owned and range from large converted farmhouses to smaller modern villas or cottages. Standards vary enormously from basic but serviceable furnishings and equipment to the more sophisticated and comfortable. Access to the houses may be by a steep or unmade track. Please ask us for house details before making your final choice.

Laundry/linen

Bedlinen and towels are provided and laundered weekly (normally one bath towel and one hand towel per person) but you should take your own beach towels. Tea towels are normally provided but quantities and sizes vary from house to house.

Cleaning

The accommodation is properly prepared for your arrival. Depending on the house and the area, the cleaning service will vary from a minimum preparation clean, to two or three times weekly. We can advise what cleaning service you can expect for your particular property. In some cases extra cleaning can be arranged during your stay (payable locally).

You are always requested to leave the property clean and tidy at the end of your stay, with dishes washed and rubbish cleared (rubbish must never be left for the cleaner). It will be cleaned after you leave and if found to be in a dirty state, extra cleaning charges will be deducted from your breakage deposit.

Fuel and water supplies

Normal summer usage of water, gas and electricity are included in your rental. There is always an extra charge payable locally, for heating and air conditioning unless otherwise specified.

Kitchens

All kitchens have a refrigerator and cooking facilities, although these do vary enormously (from full split level ovens to simple hobs and local equipment). If you intend to extensively self-cater, or if a specific kitchen item is important to you please consult a member of staff before confirming your booking. If there is a dishwasher, microwave or washing machine it will be mentioned in the house description.

Food packs

A basic pack of food & drink to provide a snack on arrival will be left in certain properties (this will be mentioned in the house description).

Swimming pools

Pools are generally open from April to October, although in some they are opened later and others all year round. (Most are not heated and may be cold in early season.) Pool sizes vary from house to house, and some have shallow and deep ends whilst others are the same depth throughout. Please ask before confirming your booking if you wish to know specific pool sizes and depths. If a pool is fenced off this will be mentioned in the house description.

Telephone facility

Most properties do not have telephones, nor telephone lines. Mobile phone cover is generally good but varies from area to area, depending on the terrain.

Ancillary services

Whilst we are happy to assist clients, when possible, with certain additional services arranged and payable locally, please note that these do not form part of our main contract, and we cannot accept any liability for them since we have no direct control over them, nor be held responsible. These include the provision of rented telephones, televisions, videos, extra cleaning or cooking services, bicycle or boat hire etc.
If things go wrong, our local agent, representative or house owner will intervene with the supplier to try to find a solution. Nor can we guarantee the reception of specific channels on satellite television, which may not be in English language.

Pets
We cannot allow pets in any property.


Rural life

Given the rural situation of many of our houses it is likely that owners or caretakers may visit their properties from time to time during your stay, to tend and water plants, crops and animals (some are part of or close to working farms). You may also be aware of unaccustomed noise such as dogs barking, cockerels crowing, sheep bleating and although sometimes offensive to our British sensibility, it is commonplace to see dogs tied up.

As in Britain, farm smells from animals and crop manure are normal in the countryside, as are insects such as flies, mosquitoes, wasps, bees and ants. Rodents also may come in from the fields in the summer and autumn.

Privacy and noise

Although our properties are in traditional areas, they are not all private or secluded. Many houses do have neighbours and if a property is completely secluded this will be mentioned in the house description. Please remember that pool cleaners and gardeners will visit regularly.

Although rural houses should enjoy relative quiet, please remember that there will always be noise of some sort, be it from tractors, delivery lorries, ebullient locals playing their radios, or simply increased traffic on local roads in the summer months.

At fiesta time music and bells will play from church towers, and fireworks are the norm in village streets. If complete privacy and/or peace is important to you, please discuss this with us before making your booking.

Conil Villas S.L. acts exclusively as intermediate for the owners of selected properties. Please read the terms of business carefully.

The following terms and conditions will apply to: (a) your use of our web site; (b) our supply of products and services; and (c) our dealings with you.
By entering, accessing or using our web site in any way, you agree to comply with our terms and conditions. If you do not accept our terms and conditions in full, you must stop using our web site immediately.
It is a condition of use of this web site that only people aged 18 or over are allowed to register/book.



Governing Law

This web site has been designed for use within Spain and the United Kingdom. By accessing this web site you are agreeing that the Courts of Spain will deal with any disputes, which may arise between you and us, and that Spanish law shall be the applicable law.

Non-Commercial Use Only

You may only use this web site for your own personal use (which will at all times be reasonable and not abusive) or for purposes legitimately connected with purchasing our products and services.
You are not allowed to access, use or copy any material or information on this web site for any commercial purpose or for any purposes which are unlawful.

Ownership and Use of Material and Information On Our Web Site

Unless otherwise stated, material and information, either whole or in part, from this web site may not be reproduced, copied, republished, downloaded, posted, broadcast or transmitted in any form or medium without our and/or the appropriate owner’s prior written permission.

OUR OBLIGATIONS

1. The Contract

The terms and conditions set out here together with your confirmation invoice comprise the agreement between Conil Villas and all those listed on the booking on whose behalf the party leader is acting.
You can book the accommodation and take up the offers advertised on this site if they are still available. We will accept your booking when you ask for your accommodation to be confirmed. However, the contract is made on the issue date on our Confirmation Invoice. We will send our Confirmation Invoice as soon as possible after receiving your booking and receiving your deposit payment. It is only then that a contract exists. If you do not receive a Confirmation Invoice within 2 weeks of paying your deposit, please contact us immediately. All telephone quotations will be confirmed in writing or by e-mail.
Payment of any monies, in particular within 8 weeks of departure, constitutes a commitment to proceed with the booking if your request is confirmed and those monies are not refundable unless your request cannot be fulfilled.
Please check carefully all the details on the confirmation invoice to ensure they are correct. Please tell us of any errors within 7 days, as we do not accept liability for errors notified after that period.
In addition to the details on the confirmation invoice, the price of your holiday includes all local taxes, including VAT.

2. Holiday Price

All prices for accommodation on this site will be confirmed to you in writing or e-mail before we confirm your booking via the Confirmation Invoice.

3. Cancellation and Changes by Us

We reserve the right to make changes after you have confirmed your booking. However, if we have to make major changes, we will tell you as soon as we can and you then have a number of options available to you.

Major Changes - Change of accommodation, cancellation of holiday. These are only examples and there may be other significant changes, which constitute Major Changes.
If we make a Major Change, or if we cancel your original booking, you may:
(a) accept the new accommodation of equivalent or closely similar standard and price offered by us; or
(b) cancel your accommodation booked with us altogether and receive a full refund of all monies paid.
You must notify us of your choice within 7 days of our offer of the replacement holiday. If you do not, we will book the replacement holiday for you. Either way, we will always pay you compensation, using the table below. This standard payment will not affect your statutory or other legal rights.

Important Notes: We will not pay compensation: (1) where the changes are due to war or threat of war, riots, civil strife, terrorist activity, industrial disputes, natural or nuclear disasters, fire, epidemics, health risks, technical problems with transport beyond our control or that of our suppliers, closure or congestion of airports, stations or ports, cancellations or changes of schedules by carriers ceasing to operate, severe weather conditions, and similar events outside our control, or (2) where we cancel because you have failed to pay the balance of your accommodation cost.

4. Our Arrangements for Your Accommodation

We will arrange for you to receive from us, or from independent suppliers contracted by us, the accommodation that you have chosen and we confirm. We are responsible for ensuring that the accommodation is supplied and to a reasonable standard, as described in this web site and any amendments.

5. Our Liability To You

Although we do not control the day-to-day operations of our suppliers, we accept responsibility for the acts and omissions of our employees, sub-contractors, and local agents acting in the course of their employment, if facilities or services which form part of the accommodation which we have promised to provide are defective. However, in some countries, local standards will not be the same as in the UK and it is not always within our control to impose our own standards there.
We do not accept responsibility if you suffer illness, injury, or death on holiday unless it is due to the negligence of our employees, agents, suppliers or sub-contractors acting in the course of their employment, provided you tell us and the relevant suppliers in resort about the incident and write to us within three months of your return from holiday.

6. Resolving Complaints

It is always our aim to settle any complaints amicably and speedily and we ask you to inform us as soon as possible of any complaint.

YOUR OBLIGATIONS

7. Your Accommodation Contract

When you wish to confirm a booking, you must pay the deposit of 40%. The deposit will be deducted from the total amount. Once your accommodation has been confirmed by us, the deposit will not be refunded unless we change or cancel your holiday as described in Clause 3.
Your contract with us is made on the terms of these Conditions, subject to the exclusive laws and jurisdiction of the Courts of the Kingdom of Spain alone.
We do not accept bookings made in the name of persons aged under 18.
It is a condition of booking that you take travel insurance. No liability will be accepted for the consequences of your travelling without adequate travel insurance.

8. Paying For Your Holiday

You must make payment to us of the balance shown on the final invoice at least 4 weeks before your departure date or, if your booking is made within this period, you must pay the full amount immediately.
If you do not pay in full by the due date, we reserve the right to treat your booking as cancelled and to charge you a cancellation charge up to 100% of the final invoice total in accordance with the scale in Clause 11. We only accept payment by credit card via our secure payment page on our website, or by cheque or bank transfer (account details will be supplied at time of booking).

9. Changing Your Booking

If you want to make any changes to your booking after we have issued a confirmation invoice, we will do our best to help. If we can meet your request, the total cost will be recalculated in accordance with the new arrangement you request, taking into account any cancellation fees or other charges payable and the prices of your new accommodation arrangements that apply on the day you ask for the change. We will charge you an amendment fee of 25€ per person.
If you want to add any new persons to the booking and we are able to confirm such change,, no amendment fee will be charged. However, we will not accept any such changes within 14 days of your departure.
After any change has been made at your request, we will issue a new Confirmation Invoice.

10. Inability to travel

If you are prevented from travelling, you may transfer your booking to another person, subject to the following conditions:
(1) you sign a letter authorising us to make the transfer;
(2) the person you transfer your booking to must comply with all terms of the existing booking;
(3) that person must confirm to us that they accept the transfer and the terms of our Booking Conditions;
(4) that person must take out new travel insurance, as your policy cannot be transferred to another person nor the premium refunded;
(5) we will charge a fee of 25€ per booking to cover the cost of processing your transfer and this will be added to the new Confirmation Invoice issued to that person;
(6) you will remain responsible for the payment of any balance on that new Invoice should that person fail to pay it;
(7) you cannot transfer a booking within 21 days of departure date.

11. Cancelling Your Booking

If you want to cancel your accommodation, you must tell us in writing immediately, by post or facsimile. Verbal cancellations will not be accepted. If you cancel, you will be liable to pay the cancellation charges set out in the table below. Cancellation charges depend on the date when your cancellation is received by us at our offices at c/Señor de la Sentencia,5-2; 41002 Seville; Spain.

15 - 55 days - 75%
14 days or less - 100%

“Period” is the period before scheduled departure date when your cancellation notification is received by us.
“Charges” are the cancellation charges expressed as a % of total accommodation cost.

If you decide in resort to curtail your holiday, for whatever reason, we will not make any refunds for any unused accommodation or other services.
Note: If you have taken out insurance you may be able to claim for any charges or losses, please check your policy.

12. Whilst On Holiday

If you want to make changes to the booked arrangements while on holiday, e.g., upgrading your accommodation, changing resort, or extending or reducing your holiday duration, changes will be subject to availability. Any extra costs or cancellation charges must be paid by you locally. All changes must be arranged with us in writing, either through our local representative/agent, or, if this is not possible, our Seville office.
The accommodation booked must only be used by those persons named on your invoice unless otherwise agreed by us in writing. You are not allowed to share the accommodation or let anyone else stay there.
You are responsible for any damage caused to your holiday accommodation during your stay, except by unknown third parties, and any justifiable charges made by the owner/hotel manager in this respect must be paid by you locally.

13. Any Problems

We make every effort to ensure that you have a trouble-free holiday. If you have a complaint about the accommodation, you must immediately inform our representative and the supplier of the service(s) in question, giving all relevant details. Until we know about a problem or complaint, we cannot begin to resolve it. It is therefore a condition of this contract that you communicate any problem to the supplier of the service(s) in question AND to our representative whilst in resort. They will do their best to resolve the matter on the spot. If you remain unhappy, the complaint in resort must be followed by a written letter of complaint which should reach our offices not later than 28 days after the end of your holiday. This must include all relevant information and your booking reference number.

14. Holiday Participation

If in the opinion of any person in authority such as accommodation owner or manager, or senior Conil Villas employee, you are likely to cause a disturbance to other guests in shared complexes because of anti-social behaviour or you do damage to property, we reserve the right to terminate your accommodation arrangements with us. We will not be liable to make alternative arrangements for other accommodation nor will we cover any costs which you incur or make any refunds. We will treat your booking as cancelled by you from that moment, and you will have to pay full cancellation charges in accordance with Clause 11.


Other important information

1. Special Requests

We will always pass on any special requests and try to meet them but do not guarantee to do so, as they do not form part of your holiday contract. Any special requests or requirements which you may have, such as special facilities for certain medical conditions, wheelchairs, specific villa allocations or any other requirement which is important to you, should be made directly in writing to us before you book. If you require the fulfilment of your request to be a condition of your contract with us, we will only have accepted it if we write to you to confirm that your request can be fulfilled. Even if we note such requests on your confirmation invoice, this does not make it part of your holiday contract.

2. Administration Charges

We reserve the right to levy an administration charge in certain circumstances to cover any additional costs incurred by us, such as contacting suppliers to check availability or special requests, returning lost property, extra administration relating to late bookings within 7 days of departure etc. This will not exceed 25€ per person.

5. Pricing, photographs and Brochure Accuracy

All prices in this web site are in Euros (€) unless otherwise stated on the individual property page and include VAT on all accommodation.
The publication date of this information is 01 March 2004. The information and prices shown in this web site are correct as of that date but may vary and the current selling prices will be shown on the specific page for each property and advised at the point of enquiry on telephone bookings. You must therefore ensure that you check all details of your chosen accommodation (including the price) with us at the time of booking. On occasions, especially during low season, certain facilities or amenities such as, swimming pools, restaurants and other local facilities etc. may not be open or available as advertised due to maintenance, weather conditions, lack of demand or for other reasons outside our control. Photographs of rooms are intended to give an overall impression rather than factual details, and not all rooms will have the same furniture or décor and it may have changed prior to your arrival.

6. Medical Problems

If you or any member of your party has any medical problem, special need or disability which may affect your holiday, please tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. In any event, you must give us full details in writing at the time of booking.

7. Health Requirements

Always check with your doctor as to which inoculations and health requirements are advisable or necessary for your holiday well before you travel. Information on health is contained in the Department of Health leaflet ‘The Travellers Guide to Health’ available from most Post Offices. For European Holidays, you should obtain a completed and issued Form E111 (details in the DoH leaflet referred to above) prior to departure. Requirements may change. You must check the up-to-date position in good time before departure. Information on these matters is given in good faith but without responsibility on our part. We regret we cannot accept any liability if you or any member of your party are refused entry onto any transport or into any country due to failure to carry correct documentation. If failure to have any necessary travel or other documents results in costs, fines or other financial penalties being incurred by us, you will be responsible for reimbursing us accordingly.

8. Star Categories/Country Standards

Villas and private houses are not hotels and as such are not currently classified by the local tourist authorities. Please rely on the descriptions we provide.

9. Data Protection and Our Privacy Policy

We will store and use the information which you supply to us or which is supplied to us about yourself and other members of your party, for the purposes set out in our Privacy Policy. If you have not been asked to agree to our use of that information at the time of supplying it, then by asking us to confirm your holiday booking, you are agreeing to our use, and we cannot accept your booking if you do not agree.

No part of the text or pictures in this website may be reproduced in any form or by any means without the prior permission of Conil Villas S.L.
Not included in our service obligations are the obligation to inform you about any changes to any circumstances that are not directly related to the property and the contracted services. This relates especially to the surroundings, beaches and regional circumstances.
